Default non-immigrant visa

Dear Alan:

Thank you very much for your consultations.

My name is Fang Wang. It was nice to talk to you. I am not sure if you understood me over the phone (my broken English). I came in New Jersey in October 10th 2008 visiting my family and my tourist visa will be expired in April 9th 2009.

I am Chinese, I worked in England for 4 years (2004-2008). I have one year tourist visa to the USA, when I ended up with my job I came here in Octorber. This is my third time I have been here. My sister suggested me to try if any chance to change a student status to stay longer. I surfed on the internet and have shortlisted 2 schools, Fairleigh Dickinson Univerisy and Kaplan College. Which one could get me a better chance of getting F1 visa? Both of tuition fee are high, how does it work to transfer from school to school? Should I submit I-539 form to USCIS again if I tranfer to cheaper school? My sister (Qin Held) is processing green card for me through his office (8/26/2005). whether this would affect my ability to get a F1 visa?

It appears that a sibling filing an I-130 on your behalf would most likely prevent you from obtaining a student visa.
