Current immigration laws now bar individuals who have stayed in the U.S. beyond their authorized stay (out of status) from re-entry for 3 or 10 years. Individuals who are out of status for more than 6 months but less than 1 year are barred from the U.S. for 3 years. If an individual is out of status for more than 1 year, then he or she will be barred for 10 years. However, these bars are only triggered if the individual leaves the U.S. and wishes to return.

The new laws also make it more difficult for illegal immigrants who have resided in the U.S. for a specified time period to avoid deportation if caught. Under the old law, they were allowed to stay if they had been living in the U.S. for seven years; now it is 10.
